Notice of Intention to Take Land for Road—Grey District
Notice is hereby given that the Grey District Council proposes to take, under the provisions of section 23 of the Public Works Act 1981, the land described in the Schedule to this notice (“Land”).
The Land is required for road and it is intended to use the Land for access, parking and utilities purposes. The reasons why the Grey District Council considers it essential to take the Land are as follows:
The legal proprietor of the land, Blackball Coal Mines Proprietary Limited, was removed from the Companies Register in or about 1940. The Land subsequently vested in the Crown, pursuant to section 337 of the Companies Act 1955.
The Commissioner of Crown Lands has confirmed that they have no interest in claiming the reversionary interest in the Land, pursuant to section 338(1) of the Companies Act 1955, and a Notice of Disclaimer has been published in the New Zealand Gazette, 14 May 2018, Notice No. 2018-go2289.
Any person having the right to object may send a written objection to the Assets and Engineering Manager, Grey District Council, PO Box 382, Greymouth 7840, within 20 working days after the date of publication of this notice.
If any objection is made in accordance with this notice, a public hearing will be held with the right of the objector to appear and be heard personally unless the objector otherwise requires and each objector will be informed of the time and place of the hearing.
Any person requiring further information in respect of this advice should contact Mel Sutherland, Assets and Engineering Manager, Grey District Council, 105 Tainui Street, Greymouth 7805. Phone: (03) 769 8611. Email: infrastructure@greydc.govt.nz.
