Pursuant to sections 130 to 133 of the Health Practitioners Competence Assurance Act 2003, the following notice is given.

Notice

1. Title and Commencement

This notice may be cited as the Nursing Council of New Zealand (Fees) Notice 2025. This notice revokes and replaces the Nursing Council of New Zealand (Fees) Notice 2024, New Zealand Gazette, 22 October 2024, Notice No. 2024-sl5433.

2. Fees and Levies

The Nursing Council of New Zealand (“Council”) sets the following fees and levies, payable to the Council, specified in the attached Schedule. All fees and levies are non-refundable.

3. Tax

The fees are inclusive of goods and services tax.

4. Rationale

The Council has reviewed its budgets and projections. See the explanatory note below.

Explanatory Note

Rationale for reapportionment to the Annual and Interim Practising Certificate (“APC”) fee – reduction in disciplinary levy and increase in general fee components of the APC fee

On 13 February 2025, the Council resolved to maintain the total of the APC fee. However, the Council did resolve to reapportion the APC fee, by reducing the disciplinary levy component and increasing the general fee component of the APC fee, to be effective from 1 April 2025.

After a review of the Council’s budgets and projections, it was identified that reserves for the disciplinary levy are higher than necessary due to an increase in nurses applying for APCs. The Council also established that general expenditure was increasing. After completing short-term and medium-term financial forecasts it was determined that total reserves would decrease over the next three years due to the expected reduced numbers of overseas applications for nursing registration.

General cost increases to the Council arise from sources such as salaries and rent, capital costs, IT systems, and project costs such as reviewing scopes of practice and nursing standards and implementing new scopes and standards.

The disciplinary levy funds the costs arising out of Professional Conduct Committee investigations and the proceedings of the Health Practitioners Disciplinary Tribunal. The Council does not have a high number of disciplinary hearings and the number of hearings each year remains relatively stable.

To ensure that the Council can manage general expenses and maintain appropriate reserves, the Council proposed to reapportion the balance between the general fee part of the APC cost and the disciplinary levy. This reapportionment will enable actual reserves to more closely match targeted reserves without affecting timeframes for disciplinary cases. Keeping the total APC fee the same now will prevent the need to raise it in the near future.

The Council consulted on reapportioning the APC fee from 5 November 2024 to 5 December 2024. The consultation was sent to all nurses with an APC. The Council received responses from individual nurses and organisations. Of the 2093 responses received to the consultation, 93% were supportive of the APC reapportioning proposal, commenting that they agreed with the Council’s rationale for the proposal and were supportive of the overall fee not increasing.
