Bylaws

1. Title

These bylaws are the Makaawhio Mātaitai Reserves Bylaws.

2. Commencement

These bylaws come into force on 1 October 2025.

3. Revocation

This notice revokes and replaces the Fisheries (Ōkahu Temporary Closure) Notice 2024 (MPI 1891), New Zealand Gazette, 2 December 2024, Notice No. 2024-sl6169.

This notice revokes and replaces the Fisheries (Popotai Taumaka Temporary Closure) Notice 2024 (MPI 1892), New Zealand Gazette, 2 December 2024, Notice No. 2024-sl6170.

4. Issue

These bylaws are issued under regulation 26 of the Fisheries (South Island Customary Fishing) Regulations 1999.

5. Application

These bylaws do not apply to commercial fishers in the following Mātaitai Reserves:

  • Mahitahi Mātaitai Reserve
  • Manakaiaua Mātaitai Reserve
  • Ōkārito Mātaitai Reserve
  • Okāhu Mātaitaii Reserve
  • Okuru Mātaitaii Reserve
  • Paringa Mātaitai Reserve
  • Popotai Taumaka Mātaitai Reserve
  • Tauneke Mātaitai Reserve
  • Tauperikaka Mātaitai Reserve

6. Interpretation

In these bylaws:

Act means the Fisheries Act 1996

hāpuku means hapuku/bass

karengo means seaweed of either of the following genera:

  1. Porphyra; or
  2. Ulva.

kōura means spiny rock lobster

kuku means mussel

Mahitahi Mātaitai Reserve means the Mahitahi Mātaitai Reserve declared by the Fisheries (Declaration and Notification of Mahitahi/Bruce Bay Mataitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2011

Manakaiaua Mātaitai Reserve means the Manakaiaua Mātaitai Reserve declared by the Fisheries (Declaration and Notification of Manakaiaua/Hunts Beach Mataitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2011

Ōkārito Mātaitai Reserve means the Ōkārito Mātaitai Reserve declared by the Fisheries (Declaration and Notification of Okarito Lagoon Mataitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2012

Okāhu Mātaitaii Reserve means the Okāhu Mātaitaii Reserve declared by the Fisheries (Declaration of Ōkahu Mātaitai Reserve) Notice 2023

Okuru Mātaitaii Reserve means the Okuru Mātaitaii Reserve declared by the Fisheries (Declaration and Notification of Okuru/Mussel Point Mataitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2011

Paringa Mātaitai Reserve means the Paringa Mātaitai Reserve declared by the Fisheries (Declaration of Paringa Mātaitai Reserve) Notice 2023

pāua means paua

Popotai Taumaka Mātaitai Reserve means the Popotai Taumaka Mātaitai Reserve declared by the Fisheries (Declaration of Popotai Taumaka Mātaitai Reserve) Notice 2023

rāwaru means blue cod

Regulations means the Fisheries (Amateur Fishing) Regulations 2013

tāmure means snapper

Tauneke Mātaitai Reserve means the Tauneke Mātaitai Reserve declared by the Fisheries (Declaration of Tauneke Mātaitai Reserve) Notice 2023

Tauperikaka Mātaitai Reserve means the Tauperikaka Mātaitai Reserve declared by the Fisheries (Declaration and Notification of Tauperikaka Mataitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2011

tuaki means cockle

(1) Terms or expressions used but not defined in these bylaws, but defined in the Act or Regulations, have the same meaning as in the Act or Regulations.

7. Vessel limits in Mātaitai Reserves

(1) Any vessel limit set in these bylaws apply when the value made from multiplying the relevant daily limit for a stock with the number of persons on that vessel, is greater than the vessel limit.

8. Ōkārito Mātaitai

(a) A person must not―

  1. take any shellfish (other than tuaki and pipi) from the Ōkārito Mātaitai Reserve; or
  2. possess any shellfish (other than tuaki and pipi) taken from within the Ōkārito Mātaitai Reserve.

(b) A person must not, on any day, take from the Ōkārito Mātaitai Reserve more than―

  1. twenty tuaki; or
  2. twenty pipi.

(c) A person must not, on any day, possess more than―

  1. twenty tuaki; or
  2. twenty pipi;―

taken from within the Ōkārito Mātaitai Reserve.

(d) A person must not―

  1. take any seaweed (other than karengo or Undaria pinnatifida) from the Ōkārito Mātaitai Reserve; or
  2. possess any seaweed (other than karengo or Undaria pinnatifida) taken from within the Ōkārito Mātaitai Reserve.

9. Manakaiaua Mātaitai

(a) A person must not―

  1. take any shellfish (other than pāua, kuku, tuaki and pipi) from the Manakaiaua Mātaitai Reserve; or
  2. possess any shellfish (other than pāua, kuku, tuaki and pipi) taken from within the Manakaiaua Mātaitai Reserve.

(b) A person must not, on any day, take from the Manakaiaua Mātaitai Reserve more than―

  1. five pāua; or
  2. twenty kuku; or
  3. twenty tuaki; or
  4. twenty pipi.

(c) A person must not, on any day, possess more than―

  1. five pāua; or
  2. twenty kuku; or
  3. twenty tuaki; or
  4. twenty pipi;―

taken from within the Manakaiaua Mātaitai Reserve.

(d) A person must not―

  1. take any seaweed (other than karengo or Undaria pinnatifida) from the Manakaiaua Mātaitai Reserve; or
  2. possess any seaweed (other than karengo or Undaria pinnatifida) taken from within the Manakaiaua Mātaitai Reserve.

10. Mahitahi Mātaitai

(a) A person must not―

  1. take any shellfish (other than kuku, tuaki and pipi) from the Mahitahi Mātaitai Reserve; or
  2. possess any shellfish (other than kuku, tuaki and pipi) taken from within the Mahitahi Mātaitai Reserve.

(b) A person must not, on any day, take from the Mahitahi Mātaitai Reserve more than―

  1. twenty kuku; or
  2. twenty tuaki; or
  3. twenty pipi.

(c) A person must not, on any day, possess more than―

  1. twenty kuku; or
  2. twenty tuaki; or
  3. twenty pipi;―

taken from within the Mahitahi Mātaitai Reserve.

(d) A person must not―

  1. take any seaweed (other than karengo or Undaria pinnatifida) from the Mahitahi Mātaitai Reserve; or
  2. possess any seaweed (other than karengo or Undaria pinnatifida) taken from within the Mahitahi Mātaitai Reserve.

11. Paringa Mātaitai

Daily Limits

(a) A person must not―

  1. take any shellfish (other than pāua, kōura, kina, kuku, tuaki and pipi) from the Paringa Mātaitai Reserve; or
  2. possess any shellfish (other than pāua, kōura, kina, kuku, tuaki and pipi) taken from within the Paringa Mātaitai Reserve.

(b) A person must not, on any day, take from the Paringa Mātaitai Reserve more than―

  1. five pāua; or
  2. twenty kuku; or
  3. twenty tuaki; or
  4. twenty pipi.

(c) A person must not, on any day, possess more than―

  1. five pāua; or
  2. twenty kuku; or
  3. twenty tuaki; or
  4. twenty pipi;―

taken from within the Paringa Mātaitai Reserve.

(d) A person must not―

  1. take from the Paringa Mātaitai Reserve any kōura that has a tail width that exceeds 70mm;
  2. possess any kōura that has a tail width that exceeds 70mm and is taken from within the Paringa Mātaitai Reserve.

(e) A person must not, on any day―

  1. take more than ten finfish from the Paringa Mātaitai Reserve; or
  2. possess more than ten finfish taken from within the Paringa Mātaitai Reserve.

(f) A person must not, on any day, take from the Paringa Mātaitai Reserve more than―

  1. five rāwaru; or
  2. two bluenose; or
  3. one hāpuku; or
  4. one kingfish; or
  5. five tāmure.

(g) A person must not, on any day, possess more than―

  1. five rāwaru; or
  2. two bluenose; or
  3. one hāpuku; or
  4. one kingfish; or
  5. five tāmure;―

taken from within the Paringa Mātaitai Reserve.

(h) A person must not―

  1. take any seaweed (other than karengo or Undaria pinnatifida) from the Paringa Mātaitai Reserve; or
  2. possess any seaweed (other than karengo or Undaria pinnatifida) taken from within the Paringa Mātaitai Reserve.
Vessel Limits

(i) The master of a vessel must ensure that, on any day, there are no more than the following on that vessel―

  1. 15 pāua
  2. 18 kōura
  3. 15 rāwaru

taken from within the Paringa Mātaitai Reserve.

(j) The master of a vessel must ensure that, on any day, there are no more than 30 finfish on that vessel, taken from within the Paringa Mātaitai Reserve.

12. Tauparikaka Mātaitai

(a) A person must not―

  1. take any shellfish (other than pāua, kina, kuku) from the Tauparikaka Mātaitai Reserve; or
  2. possess any shellfish (other than pāua, kina, kuku) taken from within the Tauparikaka Mātaitai Reserve.

(b) A person must not, on any day, take from the Tauparikaka Mātaitai Mātaitai Reserve more than―

  1. twenty kuku; or
  2. five pāua.

(c) A person must not, on any day, possess more than―

  1. twenty kuku; or
  2. five pāua;―

taken from within the Tauparikaka Mātaitai Mātaitai Reserve.

(d) A person must not―

  1. take any seaweed (other than karengo or Undaria pinnatifida) from the Tauparikaka Mātaitai Reserve; or
  2. possess any seaweed (other than karengo or Undaria pinnatifida) taken from within the Tauparikaka Mātaitai Reserve.

13. Popotai Taumaka Mātaitai

Daily Limits

(a) A person must not―

  1. take any shellfish (other than kōura, kina, kuku) from the Popotai Taumaka Mātaitai Reserve; or
  2. possess any shellfish (other than kōura, kina, kuku) taken from within the Popotai Taumaka Mātaitai Reserve.

(b) A person must not, on any day―

  1. take from the Popotai Taumaka Mātaitai Reserve more than twenty kuku; or
  2. possess more than twenty kuku taken from within the Popotai Taumaka Mātaitai Reserve.

(c) A person must not―

  1. take from the Popotai Taumaka Mātaitai Reserve any kōura that has a tail width that exceeds 70mm;
  2. possess any kōura that has a tail width that exceeds 70mm and is taken from within the Popotai Taumaka Mātaitai Reserve.

(d) A person must not, on any day―

  1. take more than ten finfish from the Popotai Taumaka Mātaitai Reserve; or
  2. possess more than ten finfish taken from within the Popotai Taumaka Mātaitai Reserve.

(e) A person must not, on any day, take from the Popotai Taumaka Mātaitai Reserve more than―

  1. five rāwaru; or
  2. two bluenose; or
  3. one hāpuku; or
  4. one kingfish; or
  5. five tāmure.

(f) A person must not, on any day, possess more than―

  1. five rāwaru; or
  2. two bluenose; or
  3. one hāpuku; or
  4. one kingfish; or
  5. five tāmure;―

taken from within the Popotai Taumaka Mātaitai Reserve.

(g) A person must not―

  1. take any seaweed (other than karengo or Undaria pinnatifida) from the Popotai Taumaka Mātaitai Reserve; or
  2. possess any seaweed (other than karengo or Undaria pinnatifida) taken from within the Popotai Taumaka Mātaitai Reserve.
Vessel Limits

(h) The master of a vessel must ensure that, on any day, there are no more than the following on that vessel―

  1. 18 kōura
  2. 15 rāwaru―

taken from within the Popotai Taumaka Mātaitai Reserve.

(i) The master of a vessel must ensure that, on any day, there are no more than 30 finfish on that vessel, taken from within the Popotai Taumaka Mātaitai Reserve.

14. Okuru Mātaitai

(a) A person must not―

  1. take any shellfish (other than kuku) from the Okuru Mātaitai Reserve; or
  2. possess any shellfish (other than kuku) taken from within the Okuru Mātaitai Reserve.

(b) A person must not, on any day―

  1. take from the Okuru Mātaitai Reserve more than twenty kuku; or
  2. possess more than twenty kuku taken from within the Okuru Mātaitai Reserve.

(c) A person must not―

  1. take any seaweed (other than karengo or Undaria pinnatifida) from the Okuru Mātaitai Reserve; or
  2. possess any seaweed (other than karengo or Undaria pinnatifida) taken from within the Okuru Mātaitai Reserve.

15. Okāhu Mātaitai

Daily Limit

(a) A person must not―

  1. take any shellfish (other than kōura, kina, kuku, tuaki, pipi, and tuatua) from the Okāhu Mātaitai Reserve; or
  2. possess any shellfish (other than kōura, kina, kuku, tuaki, pipi, and tuatua) taken from within the Okāhu Mātaitai Reserve.

(b) A person must not, on any day, take from the Okāhu Mātaitai Reserve more than―

  1. twenty kuku; or
  2. twenty tuaki; or
  3. twenty pipi; or
  4. twenty tuatua.

(c) A person must not, on any day, possess more than―

  1. twenty kuku; or
  2. twenty tuaki; or
  3. twenty pipi; or
  4. twenty tuatua;―

taken from within the Okāhu Mātaitai Reserve.

(d) A person must not―

  1. take from the Okāhu Mātaitai Reserve any kōura that has a tail width that exceeds 70mm;
  2. possess any kōura that has a tail width that exceeds 70mm and is taken from within the Okāhu Mātaitai Reserve.

(e) A person must not, on any day―

  1. take more than ten finfish from the Okāhu Mātaitai Reserve; or
  2. possess more than ten finfish taken from within the Okāhu Mātaitai Reserve.

(f) A person must not, on any day, take from the Okāhu Mātaitai Reserve more than―

  1. five rāwaru; or
  2. two bluenose; or
  3. one hāpuku; or
  4. one kingfish; or
  5. five tāmure.

(g) A person must not, on any day, possess more than―

  1. five rāwaru; or
  2. two bluenose; or
  3. one hāpuku; or
  4. one kingfish; or
  5. five tāmure;―

taken from within the Okāhu Mātaitai Reserve.

(h) A person must not―

  1. take any seaweed (other than karengo or Undaria pinnatifida) from the Okāhu Mātaitai Reserve; or
  2. possess any seaweed (other than karengo or Undaria pinnatifida) taken from within the Okāhu Mātaitai Reserve.
Vessel Limits

(i) The master of a vessel must ensure that, on any day, there are no more than the following on that vessel―

  1. 18 kōura
  2. 15 rāwaru―

taken from within the Okāhu Mātaitai Reserve.

(j) The master of a vessel must ensure that, on any day, there are no more than 30 finfish on that vessel, taken from within the Okāhu Mātaitai Reserve.

16. Tauneke Mātaitai

(a) A person must not―

  1. take any shellfish (other than pāua, kōura, kina, kuku) from the Tauneke Mātaitai Reserve; or
  2. possess any shellfish (other than kōura, kina, kuku, tuaki, pipi, and tuatua) taken from within the Tauneke Mātaitai Reserve.

(b) A person must not, on any day, take from the Tauneke Mātaitai Reserve more than―

  1. five pāua; or
  2. twenty kuku.

(c) A person must not, on any day, possess more than―

  1. five pāua; or
  2. twenty kuku;―

taken from within the Tauneke Mātaitai Reserve.

(d) A person must not―

  1. take from the Tauneke Mātaitai Reserve any kōura that has a tail width that exceeds 70mm;
  2. possess any kōura that has a tail width that exceeds 70mm and is taken from within the Tauneke Mātaitai Reserve.

(e) A person must not, on any day―

  1. take more than ten finfish from the Tauneke Mātaitai Reserve; or
  2. possess more than ten finfish taken from within the Tauneke Mātaitai Reserve.

(f) A person must not, on any day, take from the Tauneke Mātaitai Reserve more than―

  1. five rāwaru; or
  2. two bluenose; or
  3. one hāpuku; or
  4. one kingfish; or
  5. five tāmure.

(g) A person must not, on any day, possess more than―

  1. five rāwaru; or
  2. two bluenose; or
  3. one hāpuku; or
  4. one kingfish; or

taken from within the Tauneke Mātaitai Reserve.

(h) A person must not―

  1. take any seaweed (other than karengo or Undaria pinnatifida) from the Tauneke Mātaitai Reserve; or
  2. possess any seaweed (other than karengo or Undaria pinnatifida) taken from within the Tauneke Mātaitai Reserve.
Vessel Limits

(i) The master of a vessel must ensure that, on any day, there are no more than the following on that vessel―

  1. 15 pāua
  2. 18 kōura
  3. 15 rāwaru―

taken from within the Tauneke Mātaitai Reserve.

(j) The master of a vessel must ensure that, on any day, there are no more than 30 finfish on that vessel, taken from within the Tauneke Mātaitai Reserve.
