Pursuant to section 94 of the Pae Ora (Healthy Futures) Act 2022, the Crown issues the following notice.

1. Title

(1) This notice is the Assisted Dying Services Amendment Notice 2025.

(2) In this notice, the Assisted Dying Services Notice 2021, which was gazetted on 4 October 2021, and became effective from 7 November 2021 (New Zealand Gazette, Notice No. 2021-go4217, 4 October 2021), is called the “principal notice”.

2. Commencement

This notice comes into force on 4 August 2025.

3. Clause BC1 amended

The principal notice is amended by revoking clause BC1(3) in Part B, and replacing it with the new clause BC1(3) as follows:

(3) If, at any time within three working days prior to the chosen date for the administration of medication under section 20 of the Act, any of the circumstances described at subclauses (2)(a) to (d) (inclusive) occur and as a consequence the attending medical practitioner and/or attending nurse practitioner does not administer medication to the relevant person under section 20 of the Act, the attending medical practitioner and/or attending nurse practitioner may claim partial payment for Module 5 services in accordance with the Pricing Schedule. To avoid doubt, an attending medical practitioner may claim partial payment of the supervisor fee (see clause BC4(1)) or the supporting health practitioner fee (see clause BC4(2) to (4)) where applicable, and the attending nurse practitioner may claim partial payment of the supporting health practitioner fee (see clause BC4(2) to (3)) where applicable.

4. Clause BC4 amended

The principal notice is amended by revoking clause BC4(2) to (3) in Part B, and replacing it with the new clause BC4(2) to (3) as follows:

Optional Payment to Allow Another Health Practitioner to Support an Attending Medical Practitioner or Attending Nurse Practitioner to Administer Medication

(2) Where an attending medical practitioner or attending nurse practitioner will be administering medication under section 20 of the Act, that attending medical practitioner or attending nurse practitioner may request the support of a supporting health practitioner.

(3) If the supporting health practitioner:

  1. is entitled to claim payment for assisted dying services under clause CA1, the supporting health practitioner may claim the amount set out in the Pricing Schedule for providing such support; or
  2. is not themselves entitled to claim payment for assisted dying services under clause CA1, the attending medical practitioner or attending nurse practitioner may claim the amount set out in the Pricing Schedule for the services of the supporting health practitioner.

5. ‘Schedule Two – Pricing Schedule’ amended

The principal notice is amended by revoking “Module 5 – Complete” and “Module 5 – Partial” of Schedule Two – Pricing Schedule, and replacing it with the new “Module 5 – Complete” and “Module 5 – Partial” as follows:

Explanatory Note

This note is not part of the notice, but is intended to indicate its general effect.

This notice comes into force on 4 August 2025.

This notice amends the Assisted Dying Services Notice 2021 by changing the prices payable for some of the services covered by that notice.
