Pursuant to Regulation 63 of the Gas (Safety and Measurement) Regulations 2010 (“the Regulations”), I, Darren Richard Handforth, National Manager High Hazards, Energy & Public Safety, acting under the delegated authority of the Chief Executive, WorkSafe New Zealand, give the following notice:
(a) This notice is the Gas (Safety and Measurement) Regulations (Prohibition of LKK Food Equipment Ltd LKK-65 Duck Oven with flame supervision device unrelated to the main burner) Notice 2025.
(b) The prohibition contained in this notice takes effect on 26 February 2025.
(a) The sale (including an offer to sell) and use (including installation) of the following gas appliance, as described in clause 3, is prohibited:
(b) To avoid doubt, if the appliance has the following features, it is not affected by this notice:
(a) The prohibited LKK-65 is further described as follows:
(b) The following identifying marking may or may not be present on the prohibited LKK-65:
(c) The images attached to this notice show an example of the prohibited LKK-65.
(d) The specific characteristics that cause the LKK-65 to be prohibited are:
(e) The prohibited LKK-65 has been sold or supplied by LKK Food Equipment Limited.
(a) The prohibited LKK-65 is, or may be, unsafe, in that there is a significant risk that a person may suffer serious harm, or that property may suffer significant damage, as a result of dangers arising, directly or indirectly, from the use of, or passage of gas through, the gas appliance.
(b) The reason for believing the prohibited appliance is or may be unsafe is that the safety-related characteristics of a fitting that is part of the prohibited appliance are impaired so that the safety function is not served. This is due to the flame supervision device not being related to the flame of the main burner. As such, if the main burner flame was to fail then the pilot flame would not re-light the main burner and gas would be released into the appliance and surrounding air.
