Notice of Recognition of Documents Under the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999

Pursuant to Regulation 22 of the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999, I, Christopher John Thornborough, in exercise of powers delegated to me by WorkSafe New Zealand, hereby give notice of recognition of the documents listed below submitted by Ballance Agri-Nutrients Limited.

  1. Letter of endorsement from Asset Testing and Certification Limited (Inspection Body) dated 14 August 2024,
  2. Ballance Agri-Nutrients Limited ISO 9001 certificate of accreditation (BLNQ01-CCCQ02 issued by Equal Assurance Pty Ltd on 1 April 2024),
  3. A000059-ITP-001 MTM OITP (Revision 8, July 2023) Mt. Maunganui Overall Inspection and Test Plant for Pressure Equipment,
  4. Appendix 2 – Inspection Management System V10.0 Sep 2024,
  5. Ballance Mt Ops Pressure Equipment List (Revision 4), Schedule of Equipment.

This notice also serves purpose to withdraw New Zealand Gazette, 26 May 2018, Notice No. 2018-au1452 regarding historic recognition of the extended inspection interval programme for the Ballance Mt Operations Acid Plant.

The submission indicates that this equipment would be managed in a manner consistent with the requirements of the Health and Safety in Employment (Pressure Equipment, Cranes and Passenger Ropeways) Regulations 1999 (“PECPR”).

Accordingly, I advise that recognition of the inspection programme, as set out in the above detailed documentation, is granted under Regulation 22 of the PECPR Regulations.

This recognition is subject to the following conditions:

  1. Recognition applies only to pressure equipment specified in the documentation detailed within the submission.
  2. Inspection periods shall not exceed the maximum permitted by 4.4.4.1(b) “Extended Interval” of AS/NZS 3788 for all equipment listed. Any additions/alterations to the list of equipment shall be notified to WorkSafe.
  3. Ballance Agri-Nutrients Limited’s nominated Recognised Inspection Body shall determine the frequency and timing of the attendance of its equipment inspectors for the purpose of reviewing, approving and auditing the implementation of the ITP and for the inspection and certification of equipment.
  4. Ballance Agri-Nutrients Limited shall advise its nominated Recognised Inspection Body of any changes to its equipment or process that may affect safety, equipment life or the frequency or type of inspection applied. Ballance Agri-Nutrients Limited shall, in conjunction with its nominated Recognised Inspection Body, review actual or proposed changes to its equipment or process in order to establish any potential impact on safety and equipment inspection.
  5. Ballance Agri-Nutrients Limited shall advise its nominated Recognised Inspection Body of any changes to, or affecting, Ballance Agri-Nutrients Limited‘s engineering personnel.
  6. Ballance Agri-Nutrients Limited shall review its quality management system immediately, and regularly, and update it to accommodate any changes necessary following the granting of this recognition.
  7. This recognition shall remain in force for a period of five years from the date of this letter, provided all its conditions continue to be satisfied and unless cancelled in writing.
  8. Application for continued recognition will be required on or before 9 October 2029.
  9. This recognition may be withdrawn should the services of its nominated Recognised Inspection Body be discontinued or, if there is any significant change to the equipment or process.
