Code of Good Practice for New Zealand Apprenticeships Notice (2023)

Pursuant to section 378 of the Education and Training Act 2020, the Minister of Education, gives the following notice:

Title

This notice may be cited as the Education (Code of Good Practice for New Zealand Apprenticeships) Notice 2023.

Code of Good Practice for New Zealand Apprenticeships Issued

The Minister of Education issues the Code of Good Practice for New Zealand Apprenticeships (Code). The Code comes into force on 30 June 2023.

The Code is available on the Tertiary Education Commission’s website at www.tec.govt.nz.

The Code sets out the responsibilities of apprentices, their employers, and persons that carry out apprenticeship training activities.

The Code has been updated to reflect the Education and Training Act 2020, which replaced the Education Act 1989 and incorporated major reforms that gave effect to the Reform of Vocational Education.

The Code now makes reference to:

  • the Education and Training Act 2020;
  • tertiary education organisations;
  • the Education (Pastoral Care of Tertiary and International Learners) Code of Practice 2021; and
  • Tertiary Education Disputes Resolution, instead of referring to an independent mediator appointed by the Tertiary Education Commission.

The Code is secondary legislation for the purposes of the Legislation Act 2019.

Revocation

The Code of Good Practice for New Zealand Apprenticeships referred to in the New Zealand Gazette, 23 July 2015, Issue No. 77, Notice No. 2015-au4287 is revoked from the date on which the Code comes into force.

Dated at Wellington this 18th day of May 2023.

Hon JAN TINETTI, Minister of Education.
