Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Nina Weir, Land Information New Zealand, declares that pursuant to agreements to that effect having been entered into:
- Pursuant to sections 20(1) and 52(1)(b) declares the land and leasehold estate described in the First Schedule to this notice is hereby acquired subject to Conservation Covenant 9119724.2 and set apart for Sewage Treatment Purposes (Oxidation Ponds), and for Water Storage Purposes.
- Pursuant to sections 52(1)(b) and 28 declares an easement right to drain sewage to be forever appurtenant to the land described in the First Schedule is hereby acquired over the land described in the Second Schedule to this notice having the rights and powers set out in the Fourth Schedule to this notice and shall vest in the Selwyn District Council on the date of publication hereof in the New Zealand Gazette.
- Pursuant to sections 52(1)(b) and 28 declares an easement right to discharge wastewater to be forever appurtenant to the land described in the First Schedule is hereby acquired over the land described in the Third Schedule to this notice having the rights and powers set out in the Fifth Schedule to this notice and shall vest in the Selwyn District Council on the date of publication hereof in the New Zealand Gazette.

Fourth Schedule
Sewage Easement Rights and Powers
The easement shall have the implied rights and powers prescribed by the Fifth Schedule to the Land Transfer Regulations 2018.
Fifth Schedule
Discharge Wastewater Rights and Powers
- The Grantee may discharge treated domestic wastewater from the Castlehill Township and rainwater that has entered the Grantee’s Oxidation Pond located on Section 1 SO 390209 by way of border dyke irrigation.
- The Grantee must comply with the terms of Canterbury Regional Council Resource Consent CRC991052 (“Consent”) in respect of any discharge, and any amendment made to the Consent and/or any conditions of any future resource consent issued in substitution for the Consent.
- Clauses 1, 10, 11, 13 and 14 of the Fifth Schedule to the Land Transfer Regulations 2018 shall apply to the easement.
- “Easement Facility” means the border dyke irrigation drains the Grantee has constructed within the Easement Land and any associated facilities or other equipment (whether above or under the ground), and anything in replacement or substitution.
