COVID-19 Public Health Response (Authorisation of COVID-19 Orders) Notice 2022

This notice is made by the Prime Minister under section 8(c) of the COVID-19 Public Health Response Act 2020 after being satisfied that there is a risk of an outbreak or the spread of COVID-19.

Notice

1. Title

This notice is the COVID-19 Public Health Response (Authorisation of COVID-19 Orders) Notice 2022.

2. Commencement

This notice comes into force at 11.59pm on 19 October 2022.

3. Interpretation

In this notice,—

COVID-19 case means a person who has returned a positive COVID-19 result

health service means any of the following:

  1. a health service within the meaning of section 5(1) of the Health Practitioners Competence Assurance Act 2003:
  2. treatment or social rehabilitation provided under the Accident Compensation Act 2001:
  3. disability support services within the meaning of section 4 of the Pae Ora (Healthy Futures) Act 2022

mask means a covering of any type that—

  1. covers the nose and mouth of a person; and
  2. is secured to the person’s head by ear loops or a head loop

point-of-care test means any kit or other material that is intended to—

  1. be used to test for SARS-CoV-2 or COVID-19 infection or immunity (whether current or historical) in an individual; and
  2. produce a result without analysis at a laboratory

positive COVID-19 result means—

  1. definitive laboratory evidence that a person has COVID-19; or
  2. a positive result from an authorised rapid antigen test

premises includes—

  1. commercial premises or private premises (whether indoors or outdoors); and
  2. premises owned or managed by central or local government (whether indoors or outdoors); and
  3. a vehicle.

4. Authorisation Relating to COVID-19 Orders

The Prime Minister authorises the use of COVID-19 orders under the COVID-19 Public Health Response Act 2020 in relation to the following matters:

  1. self-isolation requirements for COVID-19 cases:
  2. regulation of point-of-care tests:
  3. mask requirements in health service premises.

5. Expiry of this Notice

This notice expires on 20 January 2023.

This note is not part of the notice, but is intended to indicate its general effect.

By this notice, the Prime Minister authorises the use of COVID-19 orders made under the COVID-19 Public Health Response Act 2020 (“Act”) in relation to the following matters:

  • self-isolation requirements for COVID-19 cases:
  • point-of-care test requirements:
  • mask requirements in health service premises.

This notice comes into force at 11.59pm on 19 October 2022 and will expire on 20 January 2023.

This notice is made by the Prime Minister after being satisfied that there is a risk of an outbreak or the spread of COVID-19.

The notice is one way in which the prerequisite for making a COVID-19 order under the Act can be satisfied.
