Plumbers, Gasfitters, and Drainlayers (Fees, and Disciplinary and Prosecution Levy) Notice 2021

The Plumbers, Gasfitters, and Drainlayers Board (“Board”) issues the following notice under sections 142 and 143 of the Plumbers, Gasfitters, and Drainlayers Act 2006 (“Act”).

Notice

1. Title

This notice is the Plumbers, Gasfitters, and Drainlayers (Fees, and Disciplinary and Prosecution Levy) Notice 2021.

2. Commencement

This notice comes into force on 1 January 2022.

3. Purpose

(1) This notice sets the fees, and disciplinary and prosecution levy that apply to the licensing period beginning on 1 April 2022 and onwards.

(2) This notice revokes the Plumbers, Gasfitters, and Drainlayers (Fees, and Disciplinary and Prosecution Levy) Notice 2018 (“2018 notice”), published in the New Zealand Gazette, 18 September 2018, Notice No. 2018-gs4658, with effect from 1 April 2022.

4. Interpretation

In this notice:

  1. licensing period means a period beginning on 1 April and finishing on 31 March the following year;
  2. registration class means Certifying, Tradesman, or Journeyman; and
  3. trade means sanitary plumbing, gasfitting, or drainlaying.

5. Fees, and Disciplinary and Prosecution Levy

(1) The Board sets the following fees:

6. Payment of Fees and Levy

(1) All fees are processing fees and apply whether or not an application is granted or notification accepted.

(2) Fees that are set in this notice must be paid to the Board when a person makes an application or provides a notification.

(3) Where the fee is full cost recovery, the Board will give the applicant an initial estimate. The initial estimate must be paid at the time the application is made. If the initial estimate is greater than the final processing cost, the Board will refund the difference. If the final processing fee is greater than the initial estimate, the applicant must pay the difference before the application is granted.

(4) The fee for the following matters is an annual fee which must be paid in relation to each licensing period:

  1. practising licence;
  2. notification under section 19, 21, or 25 of the Act; and
  3. trainee limited certificate.

(5) The levy must be paid to the Board once per licensing period when the person applies for a practising licence.

(6) All fees and the levy are inclusive of goods and services tax.

7. Applicable Fees and Levy

(1) The fee for an application relating to the licensing period from 1 April 2022 onwards is the fee set out in this notice.

(2) The fee for an application relating to the licensing period ending on 31 March 2022 is the fee set out in the 2018 notice.

(3) The levy which applies to the licensing period from 1 April 2022 onwards is the levy set out in this notice.

(4) The levy which applies to the licensing period ending on 31 March 2022 is the levy set out in the 2018 notice.

8. Waiver or Refund of Fees and Levy

The Board may grant a full or partial waiver or refund of any fee or levy.

This notice is issued under sections 142 and 143 of the Plumbers, Gasfitters, and Drainlayers Act 2006.

Explanatory Note

This note is not part of the notice and has been included to explain its general effect.

Under section 142 of the Act, the Board may prescribe fees in respect of certain matters. The Board may also impose a disciplinary and prosecution levy on all registered persons under section 143 of the Act.

This notice sets out the fees, and disciplinary and prosecution levy payable to the Board. The notice follows a review carried out in 2021 of Board fees and the disciplinary and prosecution levy which included sector consultation.

The fees, and disciplinary and prosecution levy set in this notice apply from 1 April 2022, or to any application for the licensing period from 1 April 2022. The fees, and disciplinary and prosecution levy in the 2018 notice apply to any application for the licensing period ending on 31 March 2022.

This notice revokes the 2018 notice with effect from 1 April 2022.
