Notice of Revocation of Ministerial Directions Issued to the Earthquake Commission

The following Ministerial Directions to the Earthquake Commission, adding additional functions to the Earthquake Commission, under the Earthquake Commission Act 1993 are revoked with effect from today:

  1. the Ministerial Direction dated 11 February 2002, as published in the New Zealand Gazette, 21 February 2002, Issue No. 16, page 482 (under which functions were added to investigate and assess the damage or endangerment of 12 homes in Waihi caused by the collapse of the gold mine in Waihi and make ex-gratia payments to home owners);
  2. the Ministerial Direction dated 1 October 2002, as published in the New Zealand Gazette, 10 October 2002, Issue No. 150, page 3901 (under which functions were added to organise and oversee the valuation of affected homes resulting from the collapse of the gold mine in Waihi on the basis of a fair and reasonable market value);
  3. the Ministerial Direction dated 14 December 2010, as published on pages 74–75 of the Earthquake Commission’s Annual Report for 2010–2011 (under which functions were added in relation to additional land remediation activities in the Canterbury region to enable EQC to investigate options to remediate certain land in these areas to a higher standard than the statutory minimum; prepare a design report for land remediation works in “Zone C” land; and carry out work to mitigate lateral spread in Spencerville); and
  4. the Ministerial Direction dated 18 April 2011, as published on pages 78–79 of the Earthquake Commission’s Annual Report for 2010–2011 (under which functions were added to enter into the Memorandum of Understanding (MOU) between the Commission and Waimakariri District Council and to carry out the Commission’s roles and responsibilities as set out in the MOU).
