Amendment to the Alternative Constitution for the Barrytown School (3290) Board of Trustees

Pursuant to section 98A of the Education Act 1989 (“Act”), I hereby amend the notice of alternative constitution for the Barrytown School Board of Trustees, published in the New Zealand Gazette, 25 August 2011, No. 134, page 3821, by

  • deleting the full Explanatory Note at the end of that notice; and
  • replacing the following text of that notice:

“Pursuant to section 105A of the Education Act 1989 ("the Act"), I approve the following constitution for the Board of Trustees of Barrytown School:

- Two trustees appointed by the Minister of Education;

- one elected parent representative; and

- the principal of the school.

The constitution will operate as if sections 96, 97, 99, 101, 102, 104 and 105 of the Act apply where relevant.”

with the following text:

“1. The alternative constitution for the Barrytown School board of trustees shall be:

    • at least one and up to three parent elected trustees;
    • the Principal of the school;
    • up to two trustees appointed by the Minister of Education;
    • up to two co-opted trustees.
  1. The constitution will operate as if sections 96, 97, 99, 101, 102, 104 and 105 of the Education Act 1989 apply where relevant.
  2. For the first election of parent representatives a returning officer will be appointed by the commissioner and will carry out the duties in accordance with the Education (School Trustees Elections) Regulations 2000.
  3. All trustees for the first board under this amended constitution will take office when the current commissioner’s appointment ends.
  4. The first term of office for trustees elected, appointed and co-opted under this amended constitution will end seven days after the next triennial election for boards of trustees in 2019.
  5. Changes to the constitution of the board will be subject to the approval of the Minister of Education and must be notified in the New Zealand Gazette.”

This notice shall come into effect on the date of publication in the New Zealand Gazette.
