Land to be Declared a Walkway—Waimate, Waimate District
Under section 31 of the Walking Access Act 2008, I declare that the land described in the Schedule below shall be a walkway and is assigned the name Ko te Ara a Taane Walkway.
I have appointed the Waimate District Council to be the controlling authority for this walkway.
The area being Section 1 SO 18206 (Record of Title CB34C/579).
The Grantor and the Grantee also agree that the easement grants a right for members of the public to pass and repass by on bicycles, including electric power-assisted bicycles (pedal cycles to which is attached one or more auxiliary electric propulsion motors having a combined maximum power output not exceeding 300 watts), and on or accompanied by a horse.
The Grantor and the Grantee also agree that subject to controlling authority approval, vehicles may be taken on to the walkway for maintenance purposes only.
The Grantor and Grantee also agree that members of the public have the right to drive, stop and park a vehicle on the area fenced and maintained as a carparking area within the easement area located at the end of Point Bush Road.
The Grantor and Grantee acknowledge that the land over which the walkway easement area has been created is protected by a covenant registered by the Queen Elizabeth the Second National Trust.
Consideration needs to be given to the covenant management and prohibitions in the covenant, when passing through and undertaking work within the covenant area.
