The Minister for Oceans and Fisheries gives the following notice under section 16(1) of the Fisheries Act 1996:

Notice

1. Title

This notice is the Fisheries (Otago Peninsula Area Emergency Commercial Set Net Restriction) Notice 2025.

2. Interpretation

In this notice:

Set net includes a gill net, ring net, or other sort of net that acts by enmeshing, entrapping, or entangling fish; but does not include a fyke net or hinaki.

3. Commencement and Expiry

This notice comes into force on 16 September 2025 at 5.00pm and expires on 16 December 2025 at 5.00pm.

4. Commercial Set Net Restriction

(1) A commercial fisher must not use a set net within the Otago Peninsula Area (Karitāne to Taieri Mouth).

(2) In this clause—

Otago Peninsula Area (Karitāne to Taieri Mouth) – means waters within a line that:

  1. commences at a point 4 nautical miles from the mean high-water mark (at 45°39.000′S and 170°47.108′E); then
  2. proceeds due east to a point at 45°39.000′S and 170°53.939′E; then
  3. proceeds in a southerly direction at a distance of 8 nautical miles from the mean high-water mark to a point at 45°51.633′S and 170°56.468′E; then
  4. proceeds in a straight line in a southerly direction to a point at 45°52.677′S and 170°54.939′E; then
  5. proceeds in a straight line in a southerly direction to a point at 45°55.067′S and 170°52.867′E; then
  6. proceeds in a straight line in a southerly direction to a point at 45°57.353′S and 170°51.635′E; then
  7. proceeds in a straight line in a southerly direction to a point at 45°59.084′S and 170°51.361′E; then
  8. proceeds in a southerly direction at a distance of 8 nautical miles from the mean high-water mark to a point at 46°05.822′S and 170°23.555′E; then
  9. proceeds in a straight line in a north-westerly direction to a point at 46°03.826′S and 170°18.565′E; and then
  10. proceeds in a northerly direction at a distance of 4 nautical miles from the mean high-water mark to the starting point (at 45°39.000′S and 170°47.108′E).
