Notice Relating to Incorporation by Reference of Material in Minerals Programme for Petroleum 2013 and Minerals Programme for Minerals (Excluding Petroleum) 2013
Pursuant to section 64 of the Legislation Act 2019, I give notice of material to be incorporated by reference into the Minerals Programme for Petroleum 2013 and the Minerals Programme for Minerals (Excluding Petroleum) 2013 (together, “the Programmes”).
The Crown Minerals Act 1991 (CMA) is supported by the Programmes which are secondary legislation that set out how the Minister for Resources and the Chief Executive of the Ministry of Business, Innovation and Employment (MBIE) will exercise their powers and interpret and apply specific provisions in the CMA and associated regulations. The Programmes also provide general operational guidance.
Public consultation on changes to update the Programmes was undertaken between November 2024 and February 2025. One of the changes consulted on was moving online some material included in the Programmes. To give effect to that change, we are proposing this information be hosted on an MBIE website (www.nzpam.govt.nz) to ensure it is more accessible and user friendly. We are also proposing this information remains part of the Programmes through a process called incorporation by reference.
The following material arises from Treaty of Waitangi (“Treaty”) settlements:
Due to the number of Treaty commitments and agreements, the proposed incorporated material comprises a large volume of text. Including this material directly in the Programmes would significantly increase their length and reduce usability. Incorporation by reference allows the Programmes to remain concise while ensuring the material is fully accessible to the public by publishing on a public website.
