Notice of the Electricity Industry Participation Code Amendment (Time-varying Pricing Requirements) 2025

1. Under section 38 of the Electricity Industry Act 2010 (“Act”), and having complied with section 39 of that Act, the Electricity Authority (“Authority”) gives notice of making the Electricity Industry Participation Code Amendment (Time-varying Pricing Requirements) 2025 (“amendment”).

2. The amendment comes into force on 1 September 2025.

3. The amendment amends Part 1, 11A and 12A of the Electricity Industry Participation Code 2010 (“Code”) to give effect to Authority decisions relating to the Energy Competition Task Force’s package 2B and 2C initiatives. The amendment requires:

  • certain retailers to offer time-of-use pricing plans in relation to consumption and injection of electricity, to promote these plans, and to provide information about them to the Authority; and
  • distributors to charge in accordance with time-varying pricing plans where offered; and
  • retailers and distributors to share and use information to enable distributors to accurately invoice.

4. The amendment is secondary legislation for the purpose of the Legislation Act 2019 and is administered by the Authority.

6. A copy of the amendment and the Code may also be inspected free of charge or purchased from the Authority, Level 7, Aon Centre, 1 Willis Street, Wellington.
