Cosmetic Products Group Standard (Amendment) Notice 2024 Amendment 2025

The Environmental Protection Authority publishes the following Amendment that it made on 8 July 2025 pursuant to section 96B and in accordance with section 96C(3) of the Hazardous Substances and New Organisms Act 1996:

Cosmetic Products Group Standard (Amendment) Notice 2024 Amendment 2025

This amendment is made under section 96B and in accordance with section 96C(3) of the Hazardous Substances and New Organisms Act 1996 (“Act”) by the Environmental Protection Authority (“Authority”).

Amendment

1. Title

This instrument is the Cosmetic Products Group Standard (Amendment) Notice 2024 Amendment 2025 (“Amendment”).

2. Commencement

This Amendment comes into force on the close of 30 December 2025.

3. Cosmetic Products Group Standard (Amendment) Notice 2024 Amended

The Amendment amends the Cosmetic Products Group Standard (Amendment) Notice 2024 (“Amendment Notice 2024”) as follows:

(1) After clause 3(3), insert:

(3A) In clause 4, subclause 4(d) replace the word “oxidizing” with “oxidising”.

(2) In clause 3(28), Schedule 2, after clause 1(e) insert:

“(f) Homosalate has the meaning given to it in Schedule 8, Table 1, entry 3, columns 2 and 3.”

(3) In clause 3(28), Schedule 2, after clause 4 insert:

4A. Phase out of products containing 15% homosalate

Despite anything in the Amendment, a person may continue to:

(a) import and manufacture cosmetic products containing homosalate that comply with the Pre-Amendment scope and conditions until 30 June 2027; and

(b) supply cosmetic products containing homosalate that comply with the Pre-Amendment scope and conditions until 30 June 2028.

(4) In clause 3(28), Schedule 2, clause 5(1) replace “Subject to subclause (2)” with “Subject to subclauses (2) and (3)”.

(5) In clause 3(28), Schedule 2, after clause 5(2) insert:

“(3) All cosmetic products containing homosalate that do not comply with the Post-Amendment scope and conditions must be disposed of by 31 March 2029.”

(6) In clause 3(37), Schedules 4 and 5 are amended to italicise all scientific and chemical names.

(7) In clause 3(37), Schedule 5, Table 1:

(a) At 2a, column 4:

(i) Replace paragraph (c) with “Other hair rinse-off products”; and

(ii) Delete paragraph (e).

(b) At 8, replace column 4 with “Hair dye substance in oxidative hair dye products”.

(c) At 8, column 5, insert “(a) and (b):”

(d) At 9, replace column 4 with:

Hair dye substance in oxidative hair dye products:

(a) General use

(b) Professional use

(e) At 12, replace column 4(c) with “Nail hardening products”

(f) At 12, column 5(d), before “0.1%” insert “≤”.

(g) At 37, column 3, insert “6818-37-7”.

(h) At 62, replace column 4 with:

(a) Leave-on products.

(b) Rinse-off products.

(i) At 65, column 3 after “85409-22-9”, insert “/8001-54-5/ 61789-71-7”

(j) At 80 and 91, column 6, delete the footnotes.

(k) At 98, final column, in the footnote, delete “and which remain in prolonged contact with the skin.”

(l) At 99, column 2 after “bisulfites”, insert “e.g. sodium sulfite, ammonium bisulfite, ammonium sulfite, potassium hydrogen sulfite, sodium bisulfite, sodium metabisulfite, potassium metabisulfite”.

(m) At 99, column 3, insert “7757-83-7 10192-30-0 10196-04-0 10117-38-1 7773-03-7 7631-90-5 7681-57-4 16731-55-8”.

(n) At 237, final column, at the end insert “a reaction to a temporary black henna tattoo in the past.”

(o) At 309, column 5, first dot point, replace “≤ 0.5%” with ≤ 0.35%”.

(p) At 323, column 6(a), after “Not to be used in” insert “primary” with a new footnote at “primary” that “Primary means the main purpose of the product is to be used as a sunscreen”.

(8) At clause 3(37), Schedule 7, Table 1:

(a) At 59, replace column 2 with “1,2,3-Propanetricarboxylic acid, 2-hydroxy-, monohydrate (citric acid) and 1,2,3-Propanetricarboxylic acid, 2-hydroxy-, silver(1+) salt, monohydrate (silver citrate)”

(b) At 59, replace column 3 with “5949-29-1 460-890-5”.

(9) At clause 3(37), in Schedule 8, Table 1 at 12, replace column 3 with “5466-77-3” and replace column 4 with “10%”.

(10) All footnote symbols are replaced with numbers and any consequential amendments are made to address footnote numbering.

4. Secondary Legislation

The Amendment is secondary legislation for the purpose of the Legislation Act 2019 and is administered by the Authority.
