The Commerce Commission (“Commission”) gives notice under section 52W of the Commerce Act 1986 (“Act”) that it has amended the Electricity Distribution Services Input Methodologies Determination 2012 [2012] NZCC 26 (“EDB IMs”), which apply to electricity distribution businesses, and the Transpower Input Methodologies Determination 2012 [2012] NZCC 17 (“Transpower IMs”), which apply to Transpower. The amendments are secondary legislation made under Part 4 of the Act and the Legislation Act 2019.

The amendments are set out in the Electricity Distribution Services Input Methodologies (Reopeners and Other Matters) Amendment Determination 2025 [2025] NZCC 5 and the Transpower Input Methodologies (Reopeners and Other Matters) Amendment Determination 2025 [2025] NZCC 4 (together, the “amendment determinations”).

The amendment determinations come into force on 27 March 2025 and amend the EDB IMs and the Transpower IMs to:

  • address discrete issues with particular provisions relating to reopeners and the reopener event allowance;
  • make changes that are necessary to give effect to our policy decisions in the IM review in 2023; and
  • improve the clarity, certainty, and workability of the IMs relating to reopeners.
