This notice is made under section 11 of the Fisheries Act 1996.

Notice

1. Title

This notice is the Fisheries (Cape Rodney to Port Jackson Spiny Rock Lobster Closure) Notice 2025.

2. Commencement

This notice comes into force on 1 April 2025.

3. Interaction with other closures

Marine reserves implemented under the Marine Reserves Act 1971 and any other closures implemented through marine protection legislation prevail over this closure. The protected areas specified within the Submarine Cables and Pipelines Protection Act 1996 prevail over this closure.

4. Interpretation

In this Notice:

Act means the Fisheries Act 1996.

Spiny rock lobster means spiny rock lobster (Jasus edwardsii).

Cape Rodney to Port Jackson area means the area of New Zealand fisheries waters bounded by a line:

1. starting at a point on the mean high-water mark at Cape Rodney (at 36°16.655′S and 174°49.296′E); then
2. proceeding due north to a point at 36°16.625′S and 174°49.296′E; then
3. proceeding in a straight line in a south-easterly direction to a point on the mean high-water mark at Port Jackson (at 36°28.825′S and 175°20.829′E); then
4. proceeding in a line in a generally westerly direction along the mean high-water mark back to the starting point at Cape Rodney (at 36°16.655′S and 174°49.296′E).

5. Cape Rodney to Port Jackson is closed for the taking of spiny rock lobster

A person must not take spiny rock lobster from the Cape Rodney to Port Jackson area.

Other Information, not part of this notice:

This notice does not restrict the taking of spiny rock lobster taken in accordance with regulations 50–52 of the Fisheries (Amateur Fishing) Regulations 2013 or the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
