1. Notice is hereby given that Auckland Council, under the provisions of section 23 of the Public Works Act 1981, proposes to take the land described in the Schedule to this notice (“Land”).

2. The Land is required for urban renewal in connection with Onehunga’s urban renewal project, known as Transform OnehungaWaiapu Precinct. In particular, it is intended the Land will create a northern entrance to the Waiapu Precinct, including a public realm connection and a supporting mixed-use residential development site.

Reasons for Taking Land

3. The reasons why Auckland Council considers it essential to take the Land are as follows:

  1. The Land forms an integral component of a major Onehunga town centre urban renewal project.
  2. Following an extensive options analysis undertaken by Auckland Council, the Land was confirmed to be the preferred location for the northern entrance to the precinct, including a public realm connection and supporting mixed-use development site.
  3. It is an integral outcome to not only repair and redevelop this public realm connection as a northern precinct entrance but also deliver other urban renewal benefits – like safer “active edges” and “more homes” in this part of the precinct.

4. The owner of the Land and those persons with a registered interest in it have been served with notice of Auckland Council’s intention to take the land and advised of their right to object.

5. Any other person having the right to object may send a written objection to the Registrar, Environment Court, Specialist Courts and Tribunals Centre, Level 2, 41 Federal Street, Auckland 1010. Postal Address: PO Box 7147, Wellesley Street, Auckland 1141, within twenty (20) working days after the date of publication of this notice.

6. If any objection is made in accordance with this notice, a public hearing will be held. The objector will have a right to appear and be heard personally unless the objector otherwise requires. Each objector will be informed of the time and place of the hearing.

7.   1. 1466 square metres (more or less) being Lot 1–3 DP 71263 contained in Record of Title NA35D/189;
  2. 3 square metres (more or less) being Lot 6 DP 71263 contained in Record of Title NA27C/1070; and
  3. 3 square metres (more or less) being Lot 7 DP 71263 contained in Record of Title NA27C/1071.

The Land is located at 123–127 Arthur Street, Onehunga, Auckland.
