As the designated person for New Zealand, and in accordance with section 43(1) of the Australian Trans-Tasman Mutual Recognition Act 1997 (“the Australian Act”), I endorse the proposed Regulations set out below for the purposes of section 45 of the Australian Act.

1. Name

This instrument is the Trans-Tasman Mutual Recognition Amendment (Tobacco Laws) Regulations 2026.

2. Commencement

(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

(2) Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3. Authority

This instrument is made under the following:

• subsections 45(3) and 47(6) of the Trans‑Tasman Mutual Recognition Act 1997 (Cth);
• subsections 185(1) of the Public Health (Tobacco and Other Products) Act 2023 (Cth).

4. Schedules

Legislation that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

5. Repeal of this instrument

This instrument is repealed on the day after it commences.

Schedule 1—Amendments

Public Health (Tobacco and Other Products) Regulations 2024 (Cth).

1. Section 12

Repeal the section.

Trans-Tasman Mutual Recognition Act 1997

2. Clause 3 of Schedule 2 (table item headed “Tobacco”)

Repeal the item, substitute:

Public Health (Tobacco and Other Products) Act 2023 (Cth)

Trans-Tasman Mutual Recognition (Continuation of Temporary Exemption of Public Health (Tobacco and Other Products Act 2023) Regulations 2025

3. The whole of the instrument

Repeal the instrument.
