Radiocommunications Regulations (Prohibited Equipment – Wireless Electronic Counter Measures Equipment) Notice 2025

Pursuant to Regulation 32(1)(i) of the Radiocommunications Regulations 2001 (“Regulations”) and acting under delegated authority from the Chief Executive, I give the following notice:

1. Title and Commencement

  1. This notice is the Radiocommunications Regulations (Prohibited Equipment – Wireless Electronic Counter Measures Equipment) Notice 2025.
  2. This notice comes into force on 10 October 2025.

2. Interpretation

In this notice:

Wireless Electronic Counter Measures Equipment means a radio transmitter or receiver that is designed, manufactured, marketed or used to disrupt, mislead, impersonate, prevent, or intercept the reception of radiocommunications, but does not include an unrestricted two-way radio device as defined in the Radiocommunications Regulations (Prohibited Equipment – Unrestricted Two Way Radio) Notice 2018.

Licence to supply radio transmitters means a licence to supply, issued in accordance with the provisions of section 131 of the Radiocommunications Act 1989.

Permitted person means a person holding a licence to supply radio transmitters or receivers, if the additional terms, conditions and restrictions of that licence allow manufacture, importation, supply, sale and/or possession of Wireless Electronic Counter Measures Equipment.

3. Prohibited Equipment

The manufacture, importation or possession of any Wireless Electronic Counter Measures Equipment by any person other than a permitted person is prohibited.

The sale or supply of Wireless Electronic Counter Measures Equipment to any person other than a permitted person is prohibited.

A permitted person who is in possession of any Wireless Electronic Counter Measures Equipment must report the following information to the Chief Executive on the basis and in the form as prescribed by the Chief Executive:

  1. a description of the Wireless Electronic Counter Measures Equipment;
  2. the location of the Wireless Electronic Counter Measures Equipment; and
  3. the capabilities of the Wireless Electronic Counter Measures Equipment.

4. Revocation

The Radiocommunications Regulations (Prohibited Equipment - Radio Jammer Equipment) Notice 2011, dated the 16th day of June 2011 and published in the New Zealand Gazette, 16 June 2011, No. 83, page 2039, is revoked.

Explanatory Note

This note is not part of the notice but is intended to indicate its general effect.

This notice replaces the 2011 Prohibition of jammers notice and broadens its remit to all active and passive wireless electronic counter measure devices.

This notice prescribes that, pursuant to Regulation 32(1)(i) of the Radiocommunications Regulations 2001, the manufacture, importation, sale, supply or possession of Wireless Electronic Counter Measures Equipment is prohibited unless the person becomes a permitted person. A person can become a permitted person by obtaining and holding an appropriate licence, which must include an endorsement for the manufacture, importation, sale, supply and/or possession of Wireless Electronic Counter Measures Equipment. The permitted person must report regularly to the Chief Executive about the particular item, its location and its capabilities.

Note that obtaining a licence to supply with this endorsement does not permit the use of Wireless Electronic Counter Measures Equipment.

This notice comes into effect on 10 October 2025.
