Notice of Entry into Possession of Mortgaged Goods
In the matter of section 156 of the Property Law Act 2007 and in the matter of the mortgage over goods (a Commercial Loan Facility Agreement dated 10 June 2021 as most recently varied by Variation Disclosure dated 31 July 2023 and a Commercial Loan Facility Agreement dated 3 August 2022 as most recently varied by Variation Disclosure dated 31 July 2023) (“Mortgage”) over a 2016 Mitsubishi Fuso Fighter truck, Registration No.: JZA794, VIN: JLFFM65FM0KJ20035; a 2016 Iveco Stralis, Registration No.: KET323, VIN: WJMS2NTH40C336346; and a 2017 Patchell 3SM Swinglift Registration No.: 6R680, VIN: 7AT0KJ07X16160813 (“Collateral”).
Notice is hereby given that on 19 December 2024, Heartland Bank Limited (“Mortgagee”) entered into possession of the Collateral following the failure of the mortgagor, R G Impex Limited to comply with the terms of the Mortgage.
The registered office of the Mortgagee is Level 3, Heartland House, 35 Teed Street, Newmarket, Auckland.
