Notice of Entry into Possession of Mortgaged Land
Mortgagor: Gray Estate Limited, 447 Te Whiti Road, RD 4, Masterton 5884.
In the matter of section 156 of the Property Law Act 2007 (“Act”) and in the matter of mortgage instrument 12786159.2 (Wellington Registry) (“Mortgage”).
Xceda Finance Limited, a duly incorporated company with its registered office at 38 Richardson Street, Whakatane, Whakatane 3120, as mortgagee (“Mortgagee”) under the Mortgage gives notice that, pursuant to orders of the High Court at Masterton in proceeding CIV-2024-435-21 Xceda Finance Limited v Gray Estate Limited and ORS dated 17 December 2024, and section 139(1)(c) of the Act, the Mortgagee entered into possession of the mortgaged land described below.
Description of Mortgaged Land: 447 Te Whiti Road, RD 4, Masterton 5884, comprised and described in Record of Title 519491 (Wellington Registry) (“Mortgaged Land”).
