In the matter of section 156 of the Property Law Act 2007 and in the matter of the Mortgage over goods (a Term Loan Agreement dated 30 May 2016, Business Overdraft Facility Agreement dated 3 November 2021, Business Term Facility Agreement, dated 19 November 2019, Term Loan Agreement, dated 25 August 2016, Business Overdraft Facility Agreement dated 28 February 2020) (“Mortgage”) over a:

  1. 2016 Log 594D Forwarder, Serial Number: ELS0594DH00000512 C/W all attachments and accessories (incl Engine Serial Number 929.929-C1108892 S/N: EL594D512);
  2. 2005 Log Max 5000 Harvester Head, Serial Number: 5000-2104);
  3. 2003 Caterpillar 320C excavator, Serial Number: CAT0320CCCLZ00223 c/w all present and after-acquired attachments and accessories; and
  4. Caterpillar C9 Acert diesel engine, Serial Number: MBD05679 (“Collateral”).

Notice is hereby given that on 18 August 2025, Heartland Bank Limited (“Mortgagee”) entered into possession of the Collateral following the failure of the mortgagor, Samson Hill Forest Harvesting Limited to comply with the terms of the Mortgage.

The registered office of the Mortgagee is Level 3, Heartland House, 35 Teed Street, Newmarket, Auckland.
