Notice of Entry into Possession of Mortgaged Goods
In the matter of section 156 of the Property Law Act 2007 and in the matter of the Mortgage over goods (a Business Loan and Security Agreement dated 17 December 2021, a Commercial Loan Facility Agreement dated 2 February 2022, a Commercial Loan Facility Agreement dated 11 October 2022 as most recently varied by Variation Disclosure dated 5 January 2024, a Commercial Loan Facility Agreement dated 9 November 2022 as most recently varied by Variation Disclosure dated 13 June 2023, a Commercial Loan Facility Agreement dated 8 June 2023 and a Commercial Loan Facility Agreement dated 19 March 2024) (“Mortgage”) over: a 2014 Iveco Stralis, Registration No.: HJD504, VIN: 6F2SFAS00EDX30008; 2007 Opinion Trailer, Registration No.: J345Z, VIN: 7A8H9000207893564; 2007 Roadmaster SG, Registration No.: K140R, VIN: 7A8KD010207002353; 2007 Roadmaster SG, Registration No.: K139R, VIN: 7A8KD010207002352; and a 2006 Volvo FH 520, Registration No.: PFD117, VIN: YV5AS50G96D128692 (“Collateral”).
Notice is hereby given that on 24 January 2025, Heartland Bank Limited (“Mortgagee”) entered into possession of the Collateral following the failure of the mortgagor, PS Logistics Limited (in liquidation) to comply with the terms of the Mortgage.
The registered office of the Mortgagee is Level 3, Heartland House, 35 Teed Street, Newmarket, Auckland.
