Notice of Application to Vary Terms of a Charitable Trust

Take notice that the JOHN RICHARD TEMPLIN SCHOLARSHIP TRUST (“trust”) will make an application to the High Court at Christchurch on Monday, 20 October 2025 at 11.45am for orders under Part 3 of the Charitable Trusts Act 1957 for approval of a scheme to alter the trust’s current trust deed by amending the criteria for the Templin Traveling Scholarship, extending and varying the powers of the trustee (Perpetual Trust Limited) and prescribing or varying the mode of administering the trust.

The Templin Traveling Scholarship (“scholarship”) is available to graduate tertiary students at the University of Canterbury and Lincoln University. The trust is applying for orders that will replace the current trust deed with a new trust deed which will make the following changes:

  • Allow discretion of the scholarship selection committee as to the quantum of the annual donation to the University of Canterbury Engineering School Library.
  • Expand the criteria for eligible scholarship applicants to: broaden the description of qualifying horticulture degrees and diplomas; remove requirements in respect of the scholarship applicant’s health or race; broaden the application of the scholarship funds to locations other than the United States of America or Canada; allow discretion of the tenure of the scholarships; and broaden the experience for which the scholarship funds can be used.
  • Remove the requirement that scholars prepare a report at the end of each year’s tenure and allow the trustee to determine whether and when a report is required.
  • Remove the requirement that trust deed alterations are to occur during the lifetime of the donor and allow the trustee to alter minor and administrative provisions of the new trust deed (but not in such a manner as to alter the charitable purposes of the new trust deed).
  • Remove obsolete roles from the scholarship selection committee and remove references to institutions that no longer exist and, if applicable, replace them with current references.
  • Make miscellaneous and minor wording amendments to the trust deed.

Any person who wishes to oppose the scheme is required to give written notice to the Registrar, the trust, and the Attorney-General not less than 7 clear days before the date of the hearing (i.e. by 12 October 2025):
