Notice of Application to Approve a Scheme Under Part III of the Charitable Trusts Act 1957

Take notice that on 27 May 2025, an application under Part III of the Charitable Trusts Act 1957 for approval of a charitable scheme varying the provisions of the Will of the late Thomas Cyril Burke was filed by Richard Michael Sprott in the High Court at Christchurch. Its reference number is CIV-2025-409-309.
The application is to be heard by the High Court at Christchurch on 30 September 2025 at 2.15pm.
3 If approved, the charitable scheme will vary the provisions of the Will to authorise Saunders and Co Solicitors to pay and distribute the sale proceeds of the deceased’s house and furniture (plus any interest) to the Sisters of St Joseph of the Sacred Heart (NZ) Trust Board (Charitable Services Registration Number: CC22358). The High Court has previously directed that the sale proceeds are the subject of a charitable gift. The variations sought are to allow the deceased’s charitable intentions to be carried out, albeit in a modified manner.
Copies of the application and the report of the Attorney-General thereon may be inspected, free of charge, at the office of the Registrar of the High Court at Christchurch or at the office of Saunders and Co Solicitors at 131 Victoria Street, Christchurch Central.
Any person who wishes to oppose the scheme must give written notice to the Registrar and the Applicant not less than 7 clear days before 30 September 2025:
