In accordance with section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority (“Authority”) gives the following notice.

Notice

1. Title and commencement

(1) This notice is the Electricity Industry (Exemption No. 363 (Meridian Energy Limited)) Exemption Notice 2025.

(2) This notice comes into force on the date it is notified in the New Zealand Gazette.

2. Exemption

(1) Meridian Energy Limited (Meridian) is exempted from complying with the obligation in clause 10.24(c) of the Electricity Industry Participation Code 2010 (“Code”) to not to use subtraction to determine submission information for ICP 0000840407WE388.

3. Term

(1) This exemption expires on the earlier of:

  1. 30 June 2031;
  2. the date when Meridian is no longer recorded in the registry as being the trader for ICP 0000840407WE388;
  3. the date when Bluecurrent Assets NZ Limited is no longer recorded in the registry as being the metering equipment provider for ICP 0000011015WEC04 or ICP 0000011055WEEA1;
  4. the date which Meridian no longer has an agreement with any trader of ICP 0000015182WE1AD, ICP 0000025029WEF4E or ICP 0003146175WE243 to receive the data required in the subtraction calculation for ICP 0000840407WE388; or
  5. the date on which the metering or distribution configuration is changed so that submission information no longer needs to be calculated by a subtractive process.

4. Conditions

(1) This exemption applies only to ICP 0000840407WE388.

5. Reasons for granting the exemption

(1) The exemption concerns a historic electrical configuration at Rotowaro Mine which requires submission information to be derived via a subtractive process.

(2) The Authority is satisfied that it is not necessary for the purpose of achieving the Authority’s objectives under section 15 of the Act for Meridian to comply with clause 10.24(c) of the Code because:

  1. submission information derived from the relevant metering installations is as accurate as it would be if it was derived using directly metered data;
  2. compliance with the relevant clause would require the distribution company or the customer to incur significant costs;
  3. granting the exemption would have a positive impact on efficiency by avoiding unnecessary costs and no impact on competition or reliability of supply.
