Notice of Recognition of Documents under the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999

Pursuant to Regulation 22 of the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999, I, Christopher John Thornborough, in exercise of powers delegated to me by WorkSafe New Zealand, hereby give notice of recognition of the documents listed below submitted by Evonik Peroxide Limited.

  1. Letter of endorsement from Supreme Inspection Services Limited (Inspection Body) dated 15 October 2024,
  2. Evonik Industries AG ISO 9001 certificate of accreditation (D-ZM-16103-01-00 issued by KPMG Cert GmbH on 13 December 2023),
  3. ES 01-03 Pressure Equipment Management System (Version 3),
  4. Qualitative RBI Methodology (15 May 2024),
  5. Evonik Site ITP 5 September 2025,
  6. 1010-A-101R, 2, 3, 4 – PSA’s Asset Management Plan.

The submission indicates that this equipment would be managed in a manner consistent with the requirements of the Health and Safety in Employment (Pressure Equipment, Cranes and Passenger Ropeways) Regulations 1999 (PECPR).

Accordingly, I advise that recognition of the inspection programme, as set out in the above detailed documentation, is granted under Regulation 22 of the PECPR Regulations.

This recognition is subject to the following conditions:

  1. Recognition applies only to pressure equipment specified in the Evonik Site ITP dated 5 September 2025 detailed within the submission. Any additions/alterations to the list of equipment shall be notified to WorkSafe.
  2. Evonik Peroxide Ltd shall provide WorkSafe with the most recent Certificates of Inspection and/or inspection results for all equipment under the PECPR Regulations within three-months from the date of this letter, on or before 10 January 2026.
  3. Evonik Peroxide Ltd shall advise its nominated Recognised Inspection Body of any changes to its equipment, process, or engineering personnel and, in conjunction with its nominated Recognised Inspection Body, review all such changes in order to establish any potential impact on safety and equipment inspection.
  4. Inspection periods shall not exceed the maximum permitted by column 6 of table 4.1 “Extended Interval” of AS 3788 for all equipment listed.
  5. Evonik Peroxide Ltd shall conduct a full gap analysis of their system to AS 3788:2024 and either adopt the 2024 version of AS 3788, or detail justification of maintaining compliance with appropriate parts of AS/NZS 3788:2006 version that leads to greater levels of safety.
  6. Evonik Peroxide Ltd shall work with its nominated Recognised Inspection Body to determine the frequency and timing of the attendance of its equipment inspectors for the purpose of reviewing, approving and auditing the implementation of the ITP and for the inspection and certification of equipment.
  7. Evonik Peroxide Ltd shall maintain its quality management system’s ISO 9001 accreditation and ensure that WorkSafe are provided and maintained with a current copy of its accreditation certificate and scope at all times. Any changes to the scope of accreditation that may affect this exemption are considered to be significant changes that must be notified to WorkSafe as soon as the changes take effect.
  8. This recognition shall remain in force for a period of five years from the date of this letter, provided all its conditions continue to be satisfied and unless cancelled in writing. Application for continued recognition will be required on or before 10 October 2030.
  9. This recognition may be withdrawn should the services of its nominated Recognised Inspection Body be discontinued or, if there is any significant change to the equipment or process.
  10. This recognition shall remain in force for the specified period in condition 8 subject to satisfactory periodic surveillance visits and/or reviews from WorkSafe.
