In accordance with section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority (“Authority”) gives the following notice.

Notice

1. Title and commencement

(1) This notice is the Electricity Industry (Exemption No. 354 (Nelson Electricity Limited)) Exemption Notice 2025.

(2) This Notice comes into force on the day after the date it is notified in the New Zealand Gazette.

2. Exemption

(1) Nelson Electricity Limited is exempted from complying with the obligations in clause 10.25(1) of the Electricity Industry Participation Code 2010 (“Code”) to ensure there is one or more metering installations for a network supply point (NSP) that is not a point of connection to the grid and that all electricity conveyed is quantified in accordance with the Code.

(2) This exemption applies only to NSP FND0112NELSNP.

3. Term

(1) This exemption expires on the earlier of:

1. the close of 30 November 2026; or
2. one month after the 33kV/11kV transformer that failed in August 2024 at the Haven Road substation is replaced.

4. Conditions

(1) This exemption applies only when the following conditions have been met:

1. Nelson Electricity Limited must use a materially accurate method to calculate consumption at NSP FND0112NELSNP (if any); and
2. Nelson Electricity Limited must reconcile the consumption at NSP FND0112NELSNP (if any) using a certified reconciliation participant.

5. Reasons for granting the exemption

(1) The reasons for granting the exemption are:

1. the exemption meets the requirements in section 11(2) of the Act;
2. Nelson Electricity Limited is acting prudently to ensure security of supply during winter 2025;
3. Nelson Electricity Limited has proposed a materially accurate method to calculate consumption for settlement if the interconnection point is used; and
4. Nelson Electricity Limited would incur unreasonable expenditure to comply with the Code.
