In accordance with section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority (“Authority”) gives the following notice.

Notice

1. Title and commencement

(1) This notice is the Electricity Industry (Exemption No. 353 (Liberta Systems Limited)) Exemption Notice 2025.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

2. Exemption

(1) Liberta Systems Limited (“Liberta”) is exempted from complying with the obligations in clause 15.38(1) of the Electricity Industry Participation Code (“Code”) to hold certification.

3. Term

(1) This exemption expires on the earlier of:

  1. the date Liberta becomes responsible for an ICP in the electricity registry after the date on which this exemption is granted; or
  2. the close of 31 October 2025 if Liberta is responsible for any ICPs in the electricity registry; or
  3. 15 months after the date Liberta is no longer responsible for any ICPs in the electricity registry (once washups have been completed).

4. Condition

(1) This exemption applies only when the following conditions have been met:

  1. Liberta (including through its agent or equivalent) must maintain sufficient processes and resources to be able to meet its obligations under the Code as it exits the market.

5. Reasons for granting the exemption

(1) The reasons for granting the exemption are:

  1. In the circumstances of the application, it is not necessary for Liberta to comply with the obligation in clause 15.38(1) of the Code to hold certification; and
  2. granting the requested exemption meets the requirements in section 11(2) of the Act.
