In accordance with section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.

Notice

1. Title and commencement

(1) This notice is the Electricity Industry (Exemption No. 351 (Kakariki Power Limited)) Exemption Notice 2025.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

2. Exemption

(1) Kakariki Power Limited (“Kakariki”) is exempted from complying with the obligations in clauses 15.38(1) and 16A.24(b) of the Electricity Industry Participation Code (“Code”) to hold certification and submit audits under part 16A of the Code.

3. Term

(1) This exemption expires on the earlier of:

  1. the close of 30 April 2027;
  2. the close of 30 April 2025 if Kakariki is responsible for any ICPs in the electricity registry;
  3. the date when Kakariki becomes responsible for an ICP in the electricity registry after 30 April 2025; and
  4. 15 months after the date Kakariki is no longer responsible for any ICPs in the electricity registry (once washups have been completed).

4. Condition

(1) This exemption applies only when the following conditions have been met:

  1. Kakariki must maintain sufficient processes and resources to be able to meet its obligations under the Code as it exits the market.

5. Reasons for granting the exemption

(1) The reasons for granting this exemption are:

  1. Previous audits indicate that Kakariki has the processes in place to manage ICPs as it exits the market;
  2. Kakariki will not be responsible for any active ICPs from 1 April 2025; and
  3. granting the requested exemption meets the requirements in section 11(2) of the Act.
