Circumstances in Which Boards May Close the Schools They Administer Under the Education (When State Schools Must be Open and Closed) Regulations 2024

Under regulation 8(5) of the Education (When State Schools Must Be Open and Closed) Regulations 2024, I specify the following circumstances in which school boards may close the schools they administer from 2025 onwards.

In each individual case the circumstances are:

  • Any closures do not exceed four half-days per school year
  • The Board must still be able to meet the minimum number of half days specified under regulation 6 for the school year
  • The Board has given at least 6 weeks’ notice to the school community in advance of the proposed closure
  • The Board has taken into account:
    • Whether there is a clear and justifiable purpose to close for instruction; and
    • The impact the closure would have on learners, whānau and the school community.

This notice is secondary legislation for the purposes of the Legislation Act 2019.

This notice was made on the 12th day of December 2024.
