Notice of the Electricity Industry Participation Code Amendment (Co-ordination of Outages Affecting Common Quality) 2024

1. Under section 38 of the Electricity Industry Act 2010 (“Act”), and having complied with section 39 of that Act, the Electricity Authority (“Authority”) gives notice of making the Electricity Industry Participation Code Amendment (Co-ordination of outages affecting common quality) 2024 (“amendment”).

2. The amendment comes into force on 1 January 2025.

3. The amendment amends clause 1.1 and Schedule 8.3, Technical Code D of Part 8 to clarify and strengthen the outage disclosure rules, allowing the system operator and asset owners to have greater visibility to coordinate asset outages effectively.

4. This amendment—

  1. clarifies that outage coordination rules for planned outages apply also for capacity reductions and unplanned outages (where appropriate)
  2. requires the grid owner to disclose all its asset outages
  3. imposes the following requirements for outage notification by other asset owners:
    1. distribution network owners must notify outages of assets that connect directly to the transmission grid
    2. intermittent generators that offer into the wholesale market must notify all outages resulting in a loss of generation capacity of 10MW or more, and
    3. all other generators that offer into the market and grid connected loads must notify all outages resulting in a capacity reduction meeting the thresholds for updating bids and offers in the market
  4. requires the asset owners described in paragraph (c) to notify any further outages if they consider the outage may impact system security or security of supply
  5. requires that outages are notified in a manner and form reasonably specified by the system operator
  6. clarifies the timing requirements for providing notice, including to make it clear that more than 12 months’ notice of an outage can be given, and
  7. makes consequential amendments related to the above.

5. The amendment is secondary legislation for the purpose of the Legislation Act 2019 and is administered by the Authority.

6. A copy of the amendment and the Electricity Industry Participation Code 2010 (“Code”) is available on the Authority’s website at: http://www.ea.govt.nz/code-and-compliance/the-code/.

7. A copy of the amendment and the Code may also be inspected free of charge or purchased from the Authority, Level 7, Aon Centre, 1 Willis Street, Wellington.
