Teaching Council of Aotearoa New Zealand (Review of Complaints Assessment Committee Decision Fee) Notice 2024

Pursuant to sections 479(1) and 480(5) of the Education and Training Act 2020, the Teaching Council of Aotearoa New Zealand (“Teaching Council”) gives notice that it will charge the Review Fee set out below, payable by a teacher or person seeking, under section 499A of the Education and Training Act 2020, a review by the Disciplinary Tribunal of a decision issued by the Complaints Assessment Committee, effective from 4 November 2024.

1. Title

This notice is the Teaching Council of Aotearoa (Review of Complaints Assessment Committee Decision Fee) Notice 2024.

2. Commencement

This notice comes into effect on 4 November 2024.

3. Review Fee

A fee (“Review Fee”) of $325.00 is payable by a teacher who is the subject of a decision of the Complaints Assessment Committee under section 497(2) or (3) of the Education and Training Act 2020, or by the person who made the complaint or report or referred the matter to the Committee under section 496 that led to the decision, where that teacher or person (as applicable) requests by way of written notice under section 499A(3) that the Disciplinary Tribunal review all or part of that decision by the Complaints Assessment Committee.

4. Tax

The Review Fee is inclusive of goods and services tax (GST).

5. Manner of Payment

From 4 November 2024 the Review Fee is the fee referred to in section 499A(3)(b) of the Education and Training Act 2020 and is payable in full to the Teaching Council at the time of requesting a review of a Complaints Assessment Committee by the Disciplinary Tribunal by written notice given under section 499A(3) of the teacher’s or person’s intention to request a review.

Explanatory Note

This note is not part of the notice but is intended to indicate its general effect.

This notice, which comes into force on 4 November 2024, sets out the fee the Teaching Council has decided to charge teachers or persons who wish to request a review by the Disciplinary Tribunal of a decision issued by the Complaints Assessment Committee.

The Education and Training Amendment Act 2022 introduced section 499A of the Education and Training Act 2020 which enables teachers or persons specified in that section to seek the review of a Complaint Assessment Committee decision by the Disciplinary Tribunal. Section 499A sets the process by which a teacher or person may request a review, including the provision of a written notice and prescribed supporting information and payment of any prescribed fee. Section 499A also sets out the powers of the Disciplinary Tribunal in carrying out this function.

This notice is issued under the authority of the Education and Training Act 2020, the Legislation Act 2019 and the Legislation (Publication) Regulations 2021.
