Notice of Watershed Meeting of Creditors to Decide the Company’s Future

Pursuant to Section 239AU of the Companies Act 1993

Notice is given that:

1. Malcolm Hollis and Richard Nacey, both Licenced Insolvency Practitioners of PricewaterhouseCoopers (“PwC”), were appointed joint and several administrators (“administrators”) of the company by the directors on 23 August 2024.
2. The watershed meeting of the creditors of the company to decide the company’s future will be held on Friday, 22 November 2024 at 10.00am. The meeting will be held at: PwC Canterbury, Level 40, 60 Cashel Street, Christchurch Central, Christchurch.
3. The business to be dealt with at the watershed meeting is to:
1. Consider the administrators’ report and opinion about the company’s business, property, affairs and financial circumstances;
2. Determine the future of the company and to address any other business that may be lawfully brought forward.
4. The texts of the resolutions to be voted on at the watershed meeting are as follows and strictly in the following order:
1. That the company should be placed into liquidation; or
2. That the administration ends, and control of the company be returned to the company’s directors.
5. Creditors may exercise their right to vote by being present in person, or by appointing a proxy or by postal vote.
