Notice Pursuant to Section 115 of the Land Transfer Act 2017
The applicant described below has applied under section 115 of the Land Transfer Act 2017 for the removal of an easement at Canterbury. The applicant claims the easement is redundant by reason of the circumstances set out below.
I intend to remove the easement on 12 December 2024 if no objections have been received before that date. You may object by giving notice to the Registrar-General of Land by 12 December 2024.

Easement: Drainage rights over part Lot 47 DP 644 shown as a blue line and 8 links wide on DP 1098 in Record of Title (RT) 785134 (burdened land) owned by Lisburn Limited and over part Lot 4 DP 490168 marked F and AF on DP 490168 in RT 712627 (burdened land) granted to Lot 3 DP 513668 in RT 826614 (benefiting land) owned by Overland Property Holdings Limited, and to Lot 1 DP 33569 in RT CB14B/857 (benefiting land) owned by Christchurch City Council, and to Lot 1 DP 51224 and Lot 1 DP 35966 both in RT CB32B/1230 and part Lot 2 DP 35966 in RT CB32B/1231 (benefiting land) both owned by Cloud Ocean Water Limited in Transfer 70384 registered on 10 May 1906.
Circumstances: The benefited land no longer adjoins the burdened land due to part of the line of pipes having been taken by Proclamation 1756 for railway purposes extinguishing this part of the easement and causing the easement corridor to no longer be continuous, as a result the abovementioned burdened and benefited land is separated.
