Notice is given under section 173(1) of the Land Transfer Act 2017 of the following application to bring part of the dry bed of an unnamed creek under the Act and issue a record of title for it made under section 172(1)(a) of the Act.

Application 12758517.2 by Mark Hawkins, Anna Louise Hawkins and TP Trustees 2022 (2) Limited, c/- Tavendale and Partners Ltd, Level 3, 329 Durham Street North (PO Box 442 ), Christchurch 8140 for land at 632 and 648 Pleasant Point-Cave Highway, Pleasant Point in the Timaru District, being 0.4000 and 0.4000 square metres more or less, and shown as part of Lots 2 and 3 on LT Plan 507120 being part of the former bed of an unnamed creek adjoining Rural Sections 12430 and 35303 comprised in Record of Titles CB22F/617 and CB22F/620 respectively in the Canterbury Land Registration District.

The applicants claim to have a right under the usque ad medium filum aquae presumption and there is no other person in possession of the land with a better claim for title.

A person specified in section 174(1) of the Act may lodge a caveat under that section to prevent the application from being granted before 16 December 2024. If no caveats are lodged, a record of title will be issued in the names of the applicants.
