Notice Pursuant to Section 115 of the Land Transfer Act 2017

The applicant described below has applied under section 115 of the Land Transfer Act 2017 for the removal of a right of way and rights to power and telephone at Wellington. The applicant claims the right of way and rights to power and telephone are redundant by reason of the circumstances set out below.

I intend to remove the right of way and rights to power and telephone on 15 October 2024 if no objections have been received before that date. You may object by giving notice to the Registrar-General of Land by 14 October 2024.

Applicant: Waikanae North Developments Limited, C/- Landlink Limited, 1 Ngaio Road, Waikanae 5036.

Easement: Right of way and rights to power and telephone over part Lot 2 DP 59299 marked A on DP 59299 in Record of Title WN30B/316 owned by Georgina Helen Watson and Shailender Yadav for the benefit of Lot 3 DP 587727 in Record of Title 1122125 owned by Peka Peka Farms Limited specified in Easement Certificate 833990.6 registered on 18 February 1987.

Circumstances: The easement is extinguished because it is redundant as the benefited land no longer adjoins the burdened land because of subdivision on DP 587727 and as a result the easement has no practical effect.
