Notice Pursuant to Section 115 of the Land Transfer Act 2017
The applicant described below has applied under section 115 of the Land Transfer Act 2017 for the removal of a right to drain water at Canterbury. The applicant claims the easement is redundant by reason of the circumstances set out below.
I intend to remove the easement on 7 October 2024 if no objections have been received before that date. You may object by giving notice to the Registrar-General of Land by 4 October 2024.
Application Number: 13059521.3
Applicant: Cashmere Land Developments Limited, C/- Beker Stone, 822 Colombo Street, Christchurch 8013.
Easement: Right to drain water over part Lot 2 DP 592620 marked RR and V on DP 592620 in Record of Title (RT) 1138267 owned by Mainland Trustee Services Limited and over part Lot 3 DP 592620 marked RQ and S on DP 592620 in RT 1138268 owned by Xiaobo Zhu for the benefit of Lot 3 DP 595807 in RT 1155570 owned by Cashmere Land Developments Limited created by Easement Instrument 12777653.10 registered on 26 September 2023.
Circumstances: The easement is extinguished because it is redundant as the benefited land no longer adjoins the burdened land because of subdivision on DP 595807 and as a result, the easement has no practical effect.
Dated at Land Information New Zealand, Christchurch this 6th day of September 2024.
AUDREY WONG, for Registrar General of Land.
