Notice Pursuant to Section 115 of the Land Transfer Act 2017
The applicant described below has applied under section 115 of the Land Transfer Act 2017 for the removal of a right of support at Canterbury. The applicant claims the easement is redundant by reason of the circumstances set out below.
I intend to remove the easement on 7 October 2024 if no objections have been received before that date. You may object by giving notice to the Registrar-General of Land by 4 October 2024.
Application Number: 13059521.2
Applicant: Cashmere Land Developments Limited, c/- Beker Stone, 822 Colombo Street, Christchurch 8013.
Easement: Right of support over part Lot 2 DP 592620 marked RR and RS on DP 592620 in Record of Title (RT) 1138267 owned by Mainland Trustee Services Limited and over part Lot 3 DP 592620 marked RQ and RP on DP 592620 in RT 1138268 owned by Xiaobo Zhu and over part Lot 4 DP 592620 marked RO on DP 592620 in RT 1138269 owned by Gavin Bruce Chinnery and Sharyn Maree Chinnery and over part Lot 9 DP 592620 marked RM and RN on DP 592620 in RT 1138274 owned by Natasha Rose Wheal and Scott Jason Walden and over part Lot 10 DP 592620 marked RK and RL on DP 592620 in RT 1138275 owned by Clive John Scrimgeour Low, Sandra Lois Low and Waimairi Trustees Limited for the benefit of Lot 3 DP 595807 in RT 1155570 owned by Cashmere Land Developments Limited created by Easement Instrument 12777653.9 registered on 26 September 2023.
Circumstances: The easement is extinguished because it is redundant as the benefited land no longer adjoins the burdened land because of subdivision on DP 595807 and as a result, the easement has no practical effect.
Dated at Land Information New Zealand, Christchurch this 6th day of September 2024.
AUDREY WONG, for Registrar-General of Land.
