Notice is given under section 173(1) of the Land Transfer Act 2017 of the following application to bring part of the dry bed of the Waitoa Stream under the Act and issue a record of title for it made under section 172(1)(a) of the Act.

Application 12563249.3 by Colin Henry Parker, Dion Phillip Edgecombe and Stacey Eileen Edgecombe, c/- Holland Beckett Law, 525 Cameron Road, Private Bag 12011, Tauranga 3143 for land at 70 and 80 Puketutu Road, Matamata in the Matamata-Piako District being 240 square metres more or less and shown as part Lot 2 on LT Plan 552700 being part of the former bed of the Waitoa Stream adjoining Lot 1 DPS 13856 comprised in Record of Title SA11D/782 in the South Auckland Land Registration District. The applicants claim to have a right under the usque ad medium filum aquae presumption and there is no other person in possession of the land with a better claim for title.

A person specified in section 174(1) of the Act may lodge a caveat under that section to prevent the application from being granted before 25 March 2024. If no caveats are lodged, a record of title will be issued in the names of the applicants.
