Notice is hereby given that Stratford District Council proposes to take, under the Public Works Act 1981, the land described in the Schedule to this notice (“Land”).

The Land is required for road.

The reasons why Stratford District Council considers it essential to take the Land are:

  • The Land prevents legal access to private property from Brewer Road (legal by virtue of sections 100(4) and (5) of the Public Works Act Amendment Act 1894). The Land is required to provide that legal access.
  • Frederick Jeffray Steuart (deceased owner) had undertaken a subdivision of his land in the 1890s. Between 1894 and 1897, the deceased owner had sold off most of the sections in the subdivision, leaving the balance land in the Certificate of Title. Most of the balance land, which includes the Land, comprises most of a section on the original plan of subdivision that was shown to be road, but which was never dedicated by the deceased owner. The subdivision and sale of land occurred prior to the enactment of the Public Works Act Amendment Act 1900, which thenceforth required subdividing owners to dedicate roads. The deceased owner died in 1926 without dedicating any land as road.
  • The original plan of subdivision showed an over-width Brewer Road, but the road legality (by virtue of sections 100(4) and (5) of the Public Works Act Amendment Act 1894) could only extend to a 20-metre width. The Land is therefore located between the legal road and privately owned sections in the original subdivision and has to be taken for road to correct the lack of road frontage.

The successors to the owners of the Land and those persons with a registered interest in it have been served with notice of Stratford District Council’s intention to take the Land and notified of their right to object.

Any person having the right to object may send a written objection to the Registrar, Environment Court, District Court Building, Level 5, 49 Balance Street, Wellington 6011, or DX SX10044, Wellington, within 20 working days after the date of publication of this notice.

If any objection is made in accordance with this notice, a public hearing will be held with the right of the objector to appear and be heard personally, unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.
