Notice of Intention to Take Easement Interest in Land for Road for the Growth Cell 4 Project—South Waikato District
Notice is hereby given that South Waikato District Council (“Council”) proposes to take, under the Public Works Act 1981, the easement being a right of way, right to drain water and sewage, right to convey water, gas, electricity and telecommunications easement over the area marked A on DP 547758 as recorded in Easement Instrument 11914121.5 (“Easement Interest”) in land described in the Schedule of this notice.
The Easement Interest is required for construction of the Growth Cell 4 Project. More particularly the underlying land is required for road.
The reasons why Council considers it essential to take the Easement Interest are as follows:
The land use is in accordance with the designation under the South Waikato District Plan.
The owner of the Easement Interest has been served with notice of the Council’s intention to take the Easement Interest and advised of their right to object.
Any other person having the right to object may send a written objection to the Deputy Registrar, Environment Court, Specialist Courts and Tribunals Centre, Level 2, 41 Federal Street, Auckland 1010, or CX10086 Auckland, within 20 working days after the date of publication of this notice.
If any objection is made in accordance with this notice, a public hearing will be held with the right of the objector to appear and be heard personally, unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.
