Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Sophie Watkins Goossens, Land Information New Zealand, declares that pursuant to an agreement to that effect having been entered into,

1. pursuant to section 20(1), the land described in the First Schedule to this notice is acquired for stormwater purposes and shall vest in the Manawatu-Whanganui Regional Council and;
2. pursuant to section 20(1) and 28, a right of way easement is acquired over the land of Thomas Joe O’Donnell and Katie Eve Bryant (the Grantor) described in the Second Schedule to this notice appurtenant to the land described in the First Schedule to this notice on the terms and conditions set out in the Third Schedule to this notice

on the date of publication hereof in the New Zealand Gazette.

The easement shall contain the rights and powers implied into rights of way and into all classes of easements as set out in Schedule 5 of the Land Transfer Regulations 2018.
