Pursuant to sections 20(1) and 28 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Nina Weir, Land Information New Zealand, declares that pursuant to agreements to that effect having been entered into, an easement right to drain water in gross, having the implied rights and powers prescribed by the Second Schedule to this notice, is hereby acquired over the land described in the First Schedule to this notice and shall vest in the Selwyn District Council on the date of publication hereof in the New Zealand Gazette.

Second Schedule

Easement Rights and Powers

The easement shall have the implied rights and powers prescribed by the Fourth Schedule to the Land Transfer Regulations 2002 added to as follows:

  1. The Grantee shall erect and maintain in good order and repair a stock proof fence along the entire boundary of the easement area, to prevent stock entering the Castle Hill Village.
  2. The Grantee is solely responsible for keeping the easement facility stockproof, the Grantor shall not be liable for any damage arising from stock gaining access to the easement facility.
  3. The Grantee shall clear and keep clear the easement area and the immediately surrounding parts of the burdened land (that part of the burdened land being within approximately 2 metres of the boundary fence) from all noxious weed and to control all other weeds, control pests (including rabbits) and vermin.
