Pursuant to sections 20(1) and 28 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Cade Couch, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the easement in gross described in the Second Schedule to this notice is acquired for the functioning indirectly of a road over the land of Moira Rebina Corrigan, Robin Moana McLaughlin, Toby Francis Werahiko Hikaka, William Fox Rangi, Loretta Rebina Tuhaka, Hihipera Eleanor Gardiner and Jayde Rangi Wilkinson as responsible trustees jointly no survivorship (“Grantor”) described in the First Schedule to this notice upon the terms and conditions set out in the Third Schedule to this notice and shall vest in the Crown (“Grantee”) on the date of publication of this notice in the New Zealand Gazette.

A right to drain water easement in gross over the land marked A on SO Plan 515819.

Rights and Powers of Required Easements

Definitions

In this easement instrument unless the context indicates otherwise water includes rain, storm, spring, soakage or seepage water, as well as water accumulated on other land and from any public road.

Terms and Conditions of Easement

  1. The easement shall contain the rights and powers implied into rights to drain water and into all classes of easements by Schedule 5 to the Land Transfer Regulations 2018 (“Regulations”).
  2. Where the terms of this instrument are in conflict with the Regulations the terms of this instrument shall prevail.
