Notice of Acceptance of Industry Body Recommendation to Not Revoke, Replace or Amend the Gas Governance (Critical Contingency Management) Amendment Regulations 2024

Following consideration of a recommendation from the Gas Industry Company Limited that I received on 2 July 2024, I give notice that I have accepted its recommendation to not revoke, replace or amend the Gas Governance (Critical Contingency Management) Amendment Regulations 2024, made 19 February 2024. These amendment regulations were made pursuant to sections 43F(2)(e) of the Gas Act 1992 (“Act”), and in reliance on section 43P of the Act.

The Gas Governance (Critical Contingency Management) Amendment Regulations 2024 removed the Broadlands and Taupō gas gates from the critical contingency threshold limits in Schedule 1 of the Gas Governance (Critical Contingency Management) Regulations 2008.

I am satisfied that the Gas Industry Company Limited has met the requirements under sections 43L and 43N of the Act to undertake consultation and complete an assessment of the proposal. I have accepted the recommendation because I consider that not revoking, replacing or amending the Gas Governance (Critical Contingency Management) Amendment Regulations 2024 will support sound arrangements for the management of critical contingencies by avoiding declaring a critical contingency event under new normal operational conditions in part of the gas transmission system.
