This notice of a recommendation that Gas Governance Regulations not be revoked, replaced or amended is issued by Gas Industry Company Limited (“Gas Industry Co”) approved as the industry body by Order in Council under section 43ZL of the Gas Act 1992 (“Act”).

On 17 February 2024 the Minister for Energy issued a notice that, following consideration of a recommendation from the Gas Industry Company Limited, and in accordance with section 43ZP of the Gas Act 1992, that he accepted the recommendation to amend the Gas Governance (Critical Contingency Management) Regulations 2008.

The resulting Gas Governance (Critical Contingency Management) Amendment regulations (“amendment regulations”) were made 19 February 2024 and came into force on 8 March 2024. The amendment regulations removed the Broadlands and Taupō gas gates from the critical contingency threshold limits in Schedule 1 of the Gas Governance (Critical Contingency Management) Regulations 2008 (“principal regulations”) which prescribes thresholds relating to the operating pressure at various points on the Maui and Vector gas pipelines.

The amendment regulations also updated some place names to align with their official spelling.

Section 43P(a) of the Act requires that, within 6 months of the amendment regulations being made, the recommending body must (i) comply with sections 43L and 43N (which relate to consultation and assessments); and (ii) make a recommendation to the Minister on whether the regulations should be revoked, replaced, or amended; and (iii) no later than 10 working days after making the recommendation, publicise the recommendation and the assessment completed under section 43N.

Recommendation

On 2 July 2024 Gas Industry Company made a recommendation to the Minister of Energy and Resources, under section 43P(a) of the Gas Act 1992, that the Gas Governance (Critical Contingency Management) Amendment Regulations 2024, made 19 February 2024 and which urgently amended Schedule 1 of the Gas Governance (Critical Contingency Management) Regulations 2008, should not be revoked, replaced or amended.
